Look.Net Domain Hosting Contract

If you have not yet received a price quote for hosting services, please complete our quote request form. We will then provide the pricing information you will need for items 3 and 8 below.

This agreement is made this _______ day of _______________, 200_ between _____________________________ (client) located at _________________________ (client's physical address), and Look.Net located at 5724 Mallow Trail, Mason Neck, Virginia 22079, USA.

1.Scope of Agreement

This is an agreement under which LOOK.NET provides Internet services, hosted under the domain name ______________________, to the client by mutual agreement.

2.Services to be Provided:

LOOK.NET will provide the following services to client:

* Provide and maintain computer hard disk space for Internet services; and
* Provide and maintain Internet network connection for Internet hosting services, subject to paragraph 5 below; and
* Domain registration with Register.com and maintenance of IP addresses on servers; and
* Two forwarding email addresses are available for each domain name registered; and
* Activity reports will be made available; and
* Full access to LOOK.NET CGI's - additional time for technical services may be billed according to LOOK.NET hourly rates; and
* Hosting fees are based 25 megabytes of storage and 512mb of downloads monthly, additional fees may apply if site exceeds these limits; and
* Provide FTP account

3.Compensation: Hosting Services

For services listed in paragraph 2, client agrees to pay LOOK.NET a non-refundable $50 account setup fee. In addition, client agrees to pay LOOK.NET $_________ per annual subscription, for the first 25 megabytes of computer hard disk space used for client Internet services and $1.00 per
month for each additional megabyte used.

The rate for the design is $75.00 an hour and $120.00 for programming, until further notice. Seeding of search engines is $135.00 for 50 search engines. Two year domain name registration with Register.com is $70.00. Register.com will bill the client directly. Client also agrees to remit all payments within fifteen
days of the date of the invoice from LOOK.NET. Bills are due upon receipt, interest at the rate of 2% per month will be charged for all amounts due over 30 days.

Repeated failure to remit timely payment shall result in the termination of service by LOOK.NET, other sections of this contract notwithstanding. In case of such termination of service, client shall remain liable, to the extent allowed
by law, for all outstanding debts and contracted services for the term owed
by client to LOOK.NET, including costs incurred by LOOK.NET to recover those debts.

4.Limitation of Liability:

LOOK.NET's liability in case of computer network, hardware, or software failure on equipment that is owned or operated by LOOK.NET, and in no case by equipment owned or operated by others, including accidental or other failure, shall be explicitly limited to no more than the refund of one month's fee paid by client to LOOK.NET, as described in paragraph 3 above. The refund of one month's fee is the exclusive remedy extended to client, for computer network, hardware, or software failure or for the breach of this contract or any other contract or guarantee, whether expressed or implied.

If the client utilizes files which do not follow the naming conventions or to Internet standard file types and html we reserve the right to not refund prepayment. Utilization of Perl scripts must be approved by LOOK.NET .

LOOK.NET shall in no way, be liable to client for any consequential damages that may be incurred by client or client customers. To the extent permitted by law, incidental and consequential damages caused by computer network, hardware, or software failure are not the responsibility of LOOK.NET and are
hereby excluded for both property damages and for personal injury damages, except as caused by the gross negligence or fraud of LOOK.NET.

5.Prohibition of Illegal Content and Activity:

Client agrees to abide by all copyright, obscenity, and other laws governing content of publications in the United States of America and the Commonwealth of Virginia.

Client agrees that LOOK.NET shall in no way be liable or held legally accountable for the content of client materials or information stored on or transmitted from LOOK.NET's computers. If in the opinion of LOOK.NET, client materials or information violate federal or state law, said materials may be removed
without warning or compensation.

6.Agreement Period:

This agreement shall be in force for the term of one year from the date that the domain is awarded. This agreement shall automatically be renewed year to year unless LOOK.NET receives written notification to terminate this agreement no later than one month prior to the end of the current term.

In case of either late or non-payment as described in paragraph 3 above, or of illegal activity as described in paragraph 5 above, LOOK.NET reserves the right to cancel service without written or other notice.

7.Modification:

The terms of this agreement may be modified or amended by mutual written agreement only.

8.Addendum:

IN WITNESS WHEREOF, the parties hereto have caused this Agreement, for the total sum of $____________ U.S. Dollars, to be executed in duplicate, each of which will be considered an original whether by fax or in it's original form, by their respective signatory officials thereunto duly
authorized as of the day and year written below.
